Terms of service for sipgate VoIP services

The subject matter of the Terms of service VoIP services is the service offering of sipgate GmbH described below.

The following specification is part of the terms and conditions of sipgate GmbH - in conjunction with the Terms of Service and with the Telecommunications Act (TKG).

1. Contract

1.1. Conclusion of the contract

Contractors are sipgate GmbH (hereinafter "sipgate"), of Gladbach Str. 74, 40219 Dusseldorf (Dusseldorf District Court, HRB 39841) and the customer. The contract is concluded in accordance with the provisions of the Terms and Conditions. If the customer has to pay a fee for the following services, the price list is governed by these specifications or by the current version of the respective price list. The current version of the respective price list for each product is linked at the end of this document.

1.2. sipgate account

sipgate provides the customer in accordance with legal and contractual provisions a so-called sipgate account. This includes the totality of the contractual relationship between the customer and sipgate relevant data. In this context, the customer is assigned a customer number. As part of this account sipgate also conducts the credit account of the customer. Every customer can per person open one account. sipgate is entitled to block additional accounts of a customer and delete them.

1.3. Term and Termination

The term of the underlying agreement for VoIP services is one calendar month. In the first month of the contract period is only the period up to the end of the month. After expiry of a calendar month, the contract is automatically extended - if it is not cancelled - by one month. The contract may be terminated by either party at any time with a period of one working day at the end of a calendar month neat (ie, there must be a full working day between the notice of termination and the date on which the notice is to be effective). 1.4. sipgate credit account

All sipgate services are prepaid services, ie to take paid services can claim sufficient funds must be charged to the credit sipgate account. 1.5. Itemised Calls

1.6. Call logs / event list

Phone calls, voicemails and text messages (events) are shown to the customer in his sipgate account. The customer can access information (date, time, etc.) of incoming and outgoing connections and make notes to individual events. sipgate stores events for the customer a maximum of 30 days. Beyond this period storage is not guaranteed. Therefore sipgate generally recommends customers make a local backup copy of each event.

1.7. Online Access

Access to sipgate website is normally available 24 hours a day. However, sipgate assumes no liability for the continuous availability, even for uninterrupted availability of the website callable functions such as call logs, online billing and itemized.

 

2. General Features for VoIP Services

2.1. General Features for VoIP connections from sipgate

2.1.1. sipgate provides the customer with the technical and operational capabilities a VoIP connection in accordance with the following regulations and the specific terms of reference for the contract chosen by the customer. The connection allows the customer to connect via a suitable Internet access via SIP in accordance with RFC 3261 with a SIP server.

2.1.2. SIP servers have a more than 365 days a year on average minimum availability of 98%. The SIP server is considered available if the client can connect to the server. Maintenance, installation and modification times are explicitly excluded from the calculation of the SIP server availability. Due to the technical realities of other telecommunications networks, the Internet connection used by the customer as well as its other hardware and software transmission quality and availability may be limited. This can potentially lead to restrictions that are not within the sphere of influence of sipgate. These restrictions sipgate is not responsible.

2.2. Call services

2.2.1. To a sipgate connection telecommunications connections can be accepted and links to other sipgate connections as well as to the public telephone network are established. The transmission probability for these compounds is 97% on average.

2.2.2. The connections to specific number ranges (eg certain value-added and information services) can not be performed via the network from sipgate in the context of Internet telephony. A list of excluded services and code can be found in the price list.

2.2.3. The preparation of compounds to geographical dial-in numbers for access to the Internet is excluded.

2.2.4. Emergency calls from the numbers 999 and 112 are possible and are forwarded using the customer's specified address to the emergency medical system. More information under Notices for transmission of emergency calls via VoIP.

Important notice: In order to be able to contact the emergency services from your sipgate account, you have to configure and activate your emergency location!

2.2.5. sipgate reserves the right to protection from abuse and in the interests of consumer protection to block calls to individual numbers, groups of numbers or certain countries in the interest of customers.

2.2.6. The dialing of a phone number is not allowed if the connection is not desired by the called party or is aware that the connection from the called party through technical means or cause to third parties is prohibited. Not permitted are particularly calls that are prohibited under the Telecommunications Act (eg, cold calls, calls from dialer).

2.2.7. A full or partial use to third parties is permitted only if this third person of the household is belong (for private use) or operation (for commercial use).

2.2.8. Under this Act, certain numbers can not be transmitted during connection establishment. These are in particular, but not exclusively, numbers for information services, Speed ​​Dial services, ground services, innovative services or premium services and foreign numbers. The Customer agrees not to violate these provisions.

2.3. Free additional features

This specification applies to such additional features that the customer can book for free on his own account or in Features Store (eg "SMS To Mail"). The scope of each of these features results from the description of each feature on the booking page or feature in the store. sipgate provides these additional services on a voluntary basis. sipgate is entitled to the provision of services according to paragraph 2.7. any time period set by the end of the current month.

2.4. sipgate voicemail

2.4.1. sipgate offers customers in particular tariff models, the ability to configure and use answering machine functions.

2.4.2. sipgate provides the customer with a voice mail. Incoming calls can be forwarded to the voicemail as needed. Voicemail messages can be accessed and downloaded through the web interface, from a connected VoIP phone or can be forwarded to an e-mail address. Voicemail messages are stored in the mp3 file format. The message length may be up to two minutes each.

2.4.3. sipgate stores voicemails for a maximum of 30 days for the customer. Beyond this period storage is not guaranteed. Therefore sipgate generally recommends customers make a local backup copy of each voicemail received.
